That was not my intent. :) ( I ramble with my own thoughts, which is what happened in that case.)
In truth, you bring up good points; ones that aren't yet resolved for OCAL, nor in my own mind.
"Jon Phillips" <jon@rejon.org> is the man to talk to about the policies, however at this stage many of the librarians work together to find out what is and is not Public Domain. Some infringing things are easy to spot; others are not so easy.

But again, I'm not concerned in the least about OCAL getting sued. My main concern in bringing up these things is about - providing for and supporting - our OCAL's claim that "The actual clipart content on open clipart library is Public domain." For me, it's about building trust, not worry. I can't speak for the other librarians.

I hope you come out of lurking mode more often! Thanks for your thoughts. :)

Cheers
Chovynz

On Thu, May 20, 2010 at 6:27 PM, Duncan Cowan <brendon.cowan@bigpond.com> wrote:
Point well taken. My lack of knowledge and experience in this field is glaringly apparent.
However, I do find it difficult to grasp the concept of blaming the library for the books.
i.e. The Vatican didn't, to my knowledge, string up Galileo's vellum binder*.
I really can't foresee a way to manually screen each upload, especially given the potentially huge,
international scope of your library. I hope there does not come a day when images of prophets become chic.
Here is a link (found)via Google images legal dept. that I thought might help.

... and I did notice, since my last post, that OCAL does carry
some 'no' (C) & 'no' TM icons. My humblest apologies to the webmaster.

*Well, it's not really a pun.. is it?
Lurking mode back on.
. . . Meanwhile 600+ users might have downloaded that NOT PD image and used it in all sorts of publications and sites, . . .
