That's the ultimate question for OCAL. :) "Is this legititamtely in the
Public Domain?"<br>
Something that maaaaaaay impact us in the future ; on first reading
some of the article I've read concern me:
<a class="moz-txt-link-freetext" href="http://www.techdirt.com/articles/20100621/2320049908.shtml">http://www.techdirt.com/articles/20100621/2320049908.shtml</a>. On a second
pass it's not a worry long term since the government would not be
concerned with private or corporate users own artwork. Then I see Hyped
up news again, and life goes on. :)<br>
<br>
Still, this has been a good discussion. Thanks Nathan, Jarod, Greg,
John and all those who have participated. Hopefully we all learned
something or at least now we are more clear on where we stand.<br>
<br>
To summarise : <br>
<ul>
<li>FreeClipartNow is another source which doesn't seem to know what
Public Domain is. We can't really trust the sources of the clipart on
that site, based on the incompatible "Fair Use" for copyrighted and
trademarked clipart that are on that site. <br>
</li>
<li>There seems to be large risk associated with FCN, so any clipart
that has directly come from there would be better off removed from the
Library, so that OCAL continues to build the trust with it's end users.
That and (I personally) respect exception statements like that, even if
I strongly dislike and disagree with them. Legally on a public domain
clipart issue, I don't think there's anything that they could do if we
DID take their clipart, but it leaves a bad taste in my mouth if I take
others work, just so that I can have more clipart.<b> I'd rather OCAL
doesn't get a reputation for that sort of thing.</b></li>
<li>OCAL is aiming to be the best clipart collection around, that
means no strings attached and minimal risk to the end user. I think
we've all agreed that we want "clean" clipart, that can be used without
risk?</li>
<li>Investigate cliparts that seem to have any association with FCN
(and other blacklisted sites). Who had it first? Is there another
source? For ones that are clearly from FCN, remove them. For clipart
that is either ours first, or from somewhere else (verifiable) and both
sites have it, these can remain in the OCAL Library.</li>
</ul>
That about sum it up?<br>
<br>
Cheers<br>
