[CREATE] Legality of using PSD documentation in FOSS implementations

Hi,

Adobe has a relatively recent version of a document describing their
PSD format on their website:
http://www.adobe.com/devnet-apps/photoshop/fileformatashtml/

I tried finding a written way to contact Adobe, but failed. So I am
asking here in case anyone knows:
Can this documentation be used in FOSS implementation of PSD support?

It is not entirely obvious from the document itself but it seems that
it is part of the Adobe Photoshop SDK, which is governed by the
following EULA:
http://www.adobe.com/devnet/photoshop/sdk/eula_generic_bak.html

I guess the major issue is if FOSS can be considered "internal
development", which might be a hard claim to make...
