This report is a little unclear. Is the problem actually libtheora 1.0beta3? 
It's not entirely clear to me if there's any problem with gstreamer at all -
you mention several versions of gstreamer, but then you say the problem is
actually with the libtheora version?

Do you have this problem on any systems that are using libtheora 1.0alpha7, or
ONLY with libtheora 1.0beta3?

If it's a libtheora problem, can you please report this at
http://bugs.xiph.org/ instead?
