Just to follow up, we've closed https://trac.xiph.org/ticket/1730 as 'wontfix'.

As you say, TH_ENCCTL_SET_DUP_COUNT isn't useful for this in a live context. We
recommend adjusting the speed-level setting on gsttheoraenc instead.
