this was actually a kernel bug which was fixed in 2.6.23 final:

commit 3eb215de26e6e94bf5fed9cb77230c383b30e53b
Author: Dmitry Torokhov <dmitry.torokhov at gmail.com>
Date: Sun Oct 7 12:22:21 2007 -0400

Driver core: fix SYSF_DEPRECATED breakage for nested classdevs

We should only reparent to a class former class devices that
form the base of class hierarchy. Nested devices should still
    grow from their real parents.

I suggest reverting commit a871c7d40e13eb247bce34aae7a9ceafaf719b10 to avoid
future confusion (and comment it adds is incomplete anyway - the issue was
only for SYSFS_DEPRECATED case).
