I think that only matters for copyright.  For trademark what matters
is whether it looks too similar.  However, IANAL, and I haven't even
seen the hat in question.  (I looked through the icons category and
also signs/logos and didn't find it.)  Like I said, if it's just a hat
that happens to be red, it's probably fine.
