Well to be a 100% sure you would need a lawyer, but as far as I am concerned
there is no problem.

They don't ask you to agree with the EULA. So you are not subject to the term
of the EULA. Remember, the A in EULA stands for Agreement. So there are only
two restrictions on that document:
1) you can't make copy of it and publish it (local copy on your computer is
subject to your countries law)
2) you can't sue Adobe for inaccuracy.

No it cannot be considered as such.
