Did a GST_Debug log and found this:

Checking gst-inspect on mpegtsmux I don't see why it gets that response:
  SRC template: 'src'
    Availability: Always
    Capabilities:
      video/mpegts
           systemstream: true
             packetsize: { 188, 192 }
