I have a bit of a mess on my side, but perhaps the key would be to add to
gstdisparity.h, after the include <cv.h> :

#include <legacy/legacy.hpp>

cv.h comes from /usr/include/opencv and legacy/legacy from /usr/include/opencv2
so who knows how the coexistence would be right now ...

I can/will try cleaning up my system to work from packages but will take me a
while - just saying ;)
