Fix BACKLOG delayed TIMEOUT trigger

The fix is simple, as to allow for a default error indication to pass to upper
layers, where the send_func is evaluated for its response to trigger keep-alive
and ultimately reset the timeout when it should not. Do not force OK if it is
not. The BACKLOG activity will still be ensured.
