This is not a bug.

The problematic paragraphs (mentioned in comment 1) have outline level set to
Level 2 (see Format-Paragraph-Outline&Numbering tab).

Table of contents by default relies on the outline (right-click on the ToC-Edit
Index; Type tab-Create From group). Usually different levels of headings have
the outline set, and normal text has it set to "Body text".

You may also like to take a look at Navigator, to see another effect of this
incorrect manual formatting.
