Trivial issue, can't say if fix is possible at all (DevEval not done), but it
would have no significance.
With those type of bugs we would always go around, another issues are with ToC
on top of document, which is itself rare and bad practice. 
Line above, even if empty is useful.
So I set WontFix. 
If I (as QA) am wrong, UX may change.
