[Libva] License of va/android/Makefile.am

Hello everyone,
   According to the main COPYING file libva is distributed under the MIT
License, however one file va/android/Makefile.am has INTEL CONFIDENTIAL
on the top and a proprietary license.
Could anyone please confirm that this is intentional, or should this be
changed to MIT?
How are the distributors supposed to package libva so as to not infringe
on this license?
