The situation is much clearer than this, and doesn't even involve
derived works: X.Org was, historically, an organisation that produced a
weak SI around which people could build real X implementations. The
licence was chosen to allow people to make their X implementations
proprietary. The GPL does not allow this, so it is not allowed in the
tree.
That's the status quo.
