Apparently the header of xf86MagicTouch.c states that it can be shared:

"...Permission is hereby granted, free of charge, to any person obtaining a
 * copy of this software and associated documentation files (the "Software"),
 * to deal in the Software without restriction, including without limitation

 * and/or sell copies of the Software, and to permit persons to whom the
 * Software is furnished to do so, subject to the following conditions:

 * all copies or substantial portions of the Software. ..."

but of course I don't know much about internal policies.
The "magictouchModuleData" seems to be there: I tried to compile it but I was
not able to manage to include required sources/headers.

XFree86 fixed it a couple years ago (but after our last import of code
from them). Someone who really cared could see if the license on it
allowed importing to X.Org's copy (i.e. is it classic MIT license or new
XFree86 license).
