Yes, the hw overlay patch was disabled for 8.10 because the performance 
seemed to be good enough, and the overlay was problematic when using 
compiz.. Now I can see that there's a bug on launchpad opened a month 
after the change was made (#278318).

Ken, you can try enabling the patch again and recompiling the driver.
