No, and actually your test 4 is the example that you ask for:

You select a chunk from para 1 to list entry 2, and your (last, and at the same
time the only) chunk ends at list entry 2 (where the cursor blinks), but it
starts at para 1, so Writer considers para 1 when looks for a *previous* list.
Para 1 does not have preceding paragraphs with lists, so Writer disallows
adding to list, despite the selection contains the list entry 2, and and even
the blinking cursor is at list entry 2. That is how it's different from test 2,
where the last chunk starts at list entry 2.
