Yes, it depend by the rtph264pay but it is also depends by the encoder.

Can vaapih264enc generates NAL of less then 1400 bytes?
Can be configured?

IIUC, you're asking about rtp payloading not h264 encoding.
You have to look into rtph264pay
And the answer is no, afaik.
