Oh...

There is only one rule. One and only one. And it is explained already.

1. Get the topmost point of the last selected chunk;
2. From that point, go to the previous paragraph;
3. Check if current paragraph (chosen at step #2) has a list applied;
4. If #3 is false, goto #2;
5. If there's no more previous paragraphs, it means that there were no
paragraphs with lists before the one from #1; disable the command and exit;
6. If we are here, we found the closest previous paragraph with list. Enable
the command; use this found paragraph's list when the command is executed.

No exceptions from the rule.
