 well the x86_64 culprit has been tracked down.

 In ViaVbeSetMode this pointer is to blame  data->block->RefreshRate

 Forcing this to a hard coded int 60.00 gives us a working driver.  Yes it
 is a horrible horrible work around.  I will try to figure out the real
 problem.
