Although the white paper does not seem to be available from
Gretag/X-Rite's website anymore, (but there are other copies around - Google
turned up:

and (by default) the document is Copyright, there weren't any other conditions
asserted on the CxF standard, and the intention was clearly to promote its free
use. In the U.S. I suppose there could be software patents, but since Gretag were
based in Europe, this is an unlikely constraint.
So there seems little to stop someone doing an independent
implementation if they choose to.
