I'm pretty sure it's still only true if the work is actually in the
public domain, i.e., if the copyright holder has released it.

J. Random Submitter cannot place a work into the public domain just by
checking a checkbox if he is not, in fact, the copyright holder.  This
is why we really need to be careful about non-PD works' slipping into
the collection.

Yeah, but we want to be sure, as much as we can, it's an accurate
statement.
