Maybe the firmware maintains a connection, or at least a WDS client?
The CTL Set Data Format command might fail silently then.  WDA should
still tell you the current mode. But I believe these WiFi devices often
filter QMI commands through a proxy, and some commands might just be
ignored (typically those the firmware needs to have full control over,
like the Data Format....).  Maybe that's the problem?
